Biography
Obatosin Ogunkeye is one of the founding partners of Allan & Ogunkeye and serves as the firm’s overall head of dispute resolution practice.
Obatosin Ogunkeye has been in active legal practice since 1975. He formed the partnership of Allan & Ogunkeye with Marlies Allan in 1982.
Obatosin Ogunkeye , in more than 44 years of advocacy practice, has been instrumental in the making of a few ground-breaking judicial decisions by Nigerian courts. Of particular note is the fact that he obtained the first Anton Piller order in a Copyright Infringement action in Nigeria. He pioneered in Nigeria, the application for the remedy of class injunctions in intellectual property infringement actions. This was an innovation to enable a country-wide injunction to be issued against all persons, whose identities are unknown, commercially dealing in a particular type of infringing product. He also pioneered the filing of a claim for the tort of unlawful interference in business interest, to enable a local authorised manufacturer or distributor of a trade-marked product, without the involvement of the trade mark proprietor, to sue a parallel importer and restrain him from selling the parallel-imported product in Nigeria. It should be noted that the validity of such a claim was affirmed by a majority decision of the Court of Appeal which was never appealed.
He continues to be innovative and ensures that all lawyers in the dispute resolution practice of the firm are, when conventional solutions for legal problems presented by clients are not feasible.
